This came in the email news feed today. I checked the date - it's not April 1st.

I was tempted to put this in the WTF? thread, that was how I reacted to it.

"If successful... it will be illegal for owners and independent mechanics to do any sort of modification or repair to any part of a motorcycle that is part of an electronic system that is protected by digital rights management (DRM)."

This could be interpreted to "include any mechanical component that affects an electronic component, which means the provision could extend as far as to outlaw basic maintenance tasks like doing an oil change, replacing a lightbulb, or changing a tire."

Here in Oz it would be almost no problem for owners - our copyright laws generally lead to restitution of profit type penalties, thus a motorbike owner breaking such copyright doing repairs won't generate profits anyway, so there's nothing to sue for. A business situation would be very different, of course., although we have consumer laws that specify vehicle owners may go to any qualified mechanic for work without losing warranties etc.

In the USA copyright laws carry far greater penalties and the system is quite different.

Also I don't know if your consumer legislation would protect independent mechanics?

There are a whole lot more independent shops, after market parts suppliers, enthusiast communities, etc. than there are OEMs. I suspect that the weight of lobbying efforts and negative press that will accompany this issue will kill this very bad idea.

Talking point: If you want to use your iThingy to play music on your car radio you have to go to the dealer to install it because it connects to the cars electrical control system (of which the radio is an integrated part now a days) and falls under digital rights management protections...

That's the interesting crossover - using IP (copyright) laws to limit non-oem work even of a spurious nature (e.g. connecting the iPod for music), but then this might be breaking various consumer law provisions.

Fascinating to watch (from afar).

It will be interesting to see where this goes exactly, and then how/if they will enforce it against individuals.
